    The (in)admissibility of the use of hypnosis as a means of obtaining evidence in the brazilian criminal process

    This paper aims to study the admissibility of forensic hypnosis as a means of obtaining evidence in Brazilian criminal proceedings. In this way, it seeks to analyze the historical and legal development of the technique, its reliability, risks and benefits. In order to better understand the subject, it unrolls everything from the concept of hypnosis to its historical evolution for application in the forensic context, based on the Brazilian legal system. Also, this paper approaches the legal conception of evidence and the means of obtaining it in Brazilian criminal proceedings. Finally, it examines the legality of forensic hypnosis in light of the Brazilian legal system, given the legislative gap for regulating the technique, together with the impacts of this gap on the validity of evidence obtained through hypnosis. To begin the investigation, it has used the inductive method to be operationalized with the techniques of referent, categories, operational concepts and research of documentary sources, resulting in a source of research for legal professionals.
