ETHICAL PRINCIPLES

The Novos Estudos Jurídicos Journal - NEJ observes the best practices in publishing and research ethics in accordance with internationally established guidelines, including the Code of Conduct and Good Practices Guidelines for Newspaper Editors, published by the Public Ethics Committee (COPE). We have listed some of the policies we have adopted in this regard, in order to reinforce and complement those discussed in the “Guidelines for Authors”.


Publisher Responsibilities

The Editors of the Novos Estudos Jurídicos Journal - NEJ have the responsibility to act in a balanced, objective and fair manner in the performance of their duties, without any form of discrimination.

All submissions are processed following the standard procedure adopted by the journal, so that articles are considered and accepted solely because of their academic/scientific merit and without commercial or political influence.

The Editors adopt and follow fair and coherent procedures in case of situations of an ethical nature or conflict, as well as giving authors the right to respond to the evaluation decisions to which they are submitted.


Responsibilities of evaluators/reviewers

The reviewers who make up the NEJ evaluator's bank have the responsibility to contribute to the decision-making process of the publication of a scientific paper, helping in a relevant way to improve the quality of the published article, revising the manuscript objectively within the deadline established in the "Guidelines for Authors ".

They must maintain the confidentiality of any information provided by the publisher or the author (s), and the retention or copying of the manuscript is prohibited.

In addition, they should alert the publisher if they identify published content (s) or submissions with suspicion of plagiarism and auto-plastering, that is, substantially similar to that under review.


Responsibilities of the author(s)

The author(s) submitting their scientific work(s) to the NEJ is(are) responsible for the journal's requirements regarding the novelty and other ethical and methodological requirements of the journal, contained in the "Guidelines for Authors".

Thus, the submitted article must be unpublished, not being subject to another evaluation process, nor published in any other national or foreign journal, unless it is published in another language and in another country, a situation in which there should be a citation that this is an article version already published in another journal.

The author(s), at the time of submitting the scientific work, adheres to the unpublished clause, becoming aware that, even after approval and publication of the article on the journal's website, identified any irregularities with respect to the ethical issue of publication, it will be immediately withdrawn and, instead, information will be included that "the article was withdrawn due to ethics in the publication".

The scientific papers submitted by the authors, in order to be accepted for publication, must comply with the following rules:

a) be appropriate to the lines of research adopted by the journal;

b) comply in full with the rules indicated in the “Guidelines for Authors”;

c) the author(s) automatically declare, at the time of submission, the work’s assignment of the right for an indefinite period, as well as the rights to exhibit, publish, reproduce, store and/or any other form of it, what is did in an express, irrevocable and irreversible manner and in full right, in a gratuitous and without any remuneration, burden or charge, in favor of the Direito e Política Electronic Journal;

d) assure that the collaboration submitted is original, recognize and cite the content reproduced from other sources;

e) the author(s) shall ensure that any studies involving humans or animals comply with national, local and institutional laws and requirements;

f) declare any potential conflict that may be considered or seen to have undue influence on the process of publication.

 
Editorial Duties Concerning Unethical Behavior

Any unethical manifestation identified in the scientific works published in the Novos Estudos Jurídicos Journal - NEJ can be brought to the publisher's attention at any time by any person, since such person provides sufficient information and evidence for an investigation to be initiated.

Evidence should be collected while avoiding spreading any claims beyond those that need to be reported.

In any case, the author should have the opportunity to respond to any allegations.

Our articles are evaluated by pairs to guarantee the quality of the scientific publication, firstly they are screened prior to distribution to the evaluators where parallel to the pre-evaluative criteria the FAREJADOR self-plagiarism software is used.

Inform or notify the author or reviewer where there appears to be misunderstanding or misapplication of acceptable standards.

Retraining or formal withdrawal of publication of the journal.

Once the investigation procedure has been completed and once unethical behavior has been established, no further contributions from the investigated author will be accepted.
