COPYRIGHT IN THE USE OF GENERATIVE AI IN TEXT PRODUCTION BY CHATGPT

Abstract

Contextualization: Information and communication technologies (ICTs) have promoted a revolution. The use of these technologies in the digital environment has provided an instant means of communication and exponentially increased the volume of available information. Several tools have emerged, and new possibilities of use have been added, which, apparently, facilitates the work of professionals in various areas in the preparation of texts, in research queries, in the performance of repetitive tasks, etc. However, the use of these tools can cause problems. An example of this is the possible impacts on the area of intellectual property, both in relation to copyright and in relation to inventors, in industrial property, both in relation to copyright and, within the scope of industrial property, to the figure of the inventor.

Objectives: To demonstrate the implications for copyright of the use of generative AI to produce texts, based on data (works or parts of works) protected by copyright.

Method: Using the deductive and monographic methods and traditional concepts that characterize copyright, authorship, originality and ownership.

Results: It is clear that there is an infringement (plagiarism) whenever generative AI tools use protected works (juxtaposition) to format other works.
