PROPOSTAS DE UMA MORATÓRIA GLOBAL DA PESCA DE ARRASTO DE FUNDO: CENÁRIOS E POSSIBILIDADES JURÍDICAS

Resumo

Contextualização do tema: O presente artigo tem por escopo analisar os cenários e possibilidades jurídicas de uma moratória da pesca de arrasto de fundo no alto-mar no contexto das mobilizações da comunidade internacional e sociedade civil por sustentabilidade oceânica nas últimas décadas.

Objetivos: O objetivo geral deste trabalho é descrever as possibilidades jurídicas e limitações fáticas de uma moratória da pesca de arrasto de fundo no alto-mar. Tem-se também quatro objetivos específicos: 1) descrever os impactos socioambientais da pesca de arrasto de fundo; 2) descrever a proteção jurídico-ambiental da pesca sob a égide do Direito do Mar; 3) descrever os esforços institucionais unilaterais e multilaterais relativamente ao banimento da pesca de arrasto de fundo; e, por fim, 4) descrever as possibilidades jurídicas das propostas de moratória de pesca de arrasto de fundo.

Metodologia: a pesquisa tem caráter descritivo. Utiliza-se método de pesquisa bibliográfica e documental. São utilizadas técnicas de coleta de pesquisa bibliográfica e análise de conteúdo. A técnica de análise é qualitativa.

Resultados: Concluiu-se que o Direito do Mar respalda a adoção de uma medida que proíba de maneira permanente a pesca de arrasto de fundo.

Kariza Dias Lopes, Universidade Federal do Rio Grande - FURG

Mestranda no Programa de Pós-Graduação em Direito e Justiça Social da Universidade Federal do Rio Grande (2022-2024). Bacharela em Direito pela Universidade Federal do Rio Grande (2021). Advogada inscrita na Ordem dos Advogados do Brasil, seccional do Estado do Rio Grande do Sul (OAB/RS). Atuante na área do Direito Civil. Atualmente integrante do Laboratório de Pesquisas em Política e Direito do Mar - LABMAR, bem como do Projeto de Pesquisa e Extensão Cidadania, Direito e Justiça (CIDIJUS), certificado pelo CNPq, mantido pela Faculdade de Direito (FaDir) da Universidade Federal do Rio Grande (FURG), que presta assessoria às comunidades de pescadores dos Municípios de Rio Grande (RS) e São José do Norte (RS), que tem como linha de pesquisa políticas públicas e direitos sociais. Pesquisa nas áreas do Direito, Direitos Humanos, Direito Ambiental, Justiça Social, e direitos relativos à pesca sustentável.
