ERADICATION OF CHILD LABOUR FROM THE PERSPECTIVE OF THE RIGHT TO FRATERNITY AND DEVELOPMENT

Abstract

Contextualization of the theme: The Construction of law and the social context has been rethought, and one of the most prominent themes is the (re)insertion of fraternal thinking in the legal context, whether having fraternity as a paradigm to guide conduct and public policies, or as a guiding and interpretive principle, molding itself to social practices and, consequently, to reality. Likewise, the need to provide social development, by eradicating harmful social practices. Objectives: The objective of the work is to analyze the theme related to the eradication of child labor as a corollary of the right to fraternity and development.

Methodology: As for the methodology, we opted for qualitative research, combined with a bibliographic procedure, based on the reading of Amartya Sen's Work, Development as freedom (2010), and in the Doctoral thesis by Doctor Clara Cardoso Machado Jaborandy (2016), “Fraternity in Brazilian  Constitutional Law: An Instrument for the Protection of Transindividual Fundamental Rights”.

Results: There have been absolutely significant advances in terms of the eradication of child labor, but all these advances cannot be allowed to suffer any type of regression, otherwise millions of children will be thrown into a potentially poor and excluded life in the globalized world. It is evident, through the reasoning developed, that the possible global increase in family income through work has an irrelevant positivity in the face of the numerous negative repercussions for the child himself and his dignity, for his family circle and for society as a all.
