DOES NATIONALITY MATTER? A LOOK AT THE INTER-AMERICAN COURT OF HUMAN RIGHTS

Contextualization: This study investigates the impact of the nationality of judges of the Inter-American Court of Human Rights (IACtHR) on decision-making in cases of human rights violations involving States under its jurisdiction. The central interest is to understand whether extralegal factors, such as nationality, influence judicial behavior within the IACtHR.
Objectives: To outline the decision-making profile of the IACtHR considering the nationality of its judges and to assess the relevance of this factor in the decisions rendered, testing the hypothesis that nationality influences decisions when the judge's home country is involved in the case.
Methodology: The research used a database containing judges' votes in cases decided by the IACtHR. A logistic regression technique was applied to test the hypothesis. The study is structured into four sections: literature review on the topic, analysis of the selection process of IACtHR judges, presentation of the database and methodology, and discussion of the results.
Results: The results show that nationality is a determining extralegal factor in decision-making when the judge's home country is the defendant. A significant negative correlation was observed between condemnatory votes and the existence of a nationality link between the judge and the defendant State.
