DIALOGUE BETWEEN JUDGES IN THE FRAGMENTED ORDER OF POST-NATIONAL LAW

Abstract

Background: Initially, we outline the main structural elements of the post-national legal order. Next, we highlight two opposing visions, constitutionalism and pluralism, aligning their proposals regarding post-national law, as well as the criticisms that are addressed to them. Finally, we investigate the existence of cross-interpretations between litigation of the Inter-American Court of Human Rights and other instances of international conflict resolution, through of explicit and implicit references. Therefore, the present study is limited to issues pertinent to the structure of the post-national legal order, such as the relationship between different rights and jurisdictions.

 

Objectives: The objective of this article is to analyze the internationalization of law based on the dialogue between judges of the Inter-American Court of Human Rights and those of other instances of international conflict resolution.

 

Method: For this, we carried out dogmatic-legal research, according to the hypothetical-deductive method, based on qualitative analysis and through the review of the specialized literature on the subject.

 

Results: We conclude that the new relations between the local and the global have implied a shift to a post-national legal order in which different rights and jurisdictions operate in separate but intermingling spheres, whose antagonisms can be minimized by the process of cross-fertilization as a tool for the construction of an order in international law by filling any gaps arising from the process of fragmentation of this law. Without manifesting pretensions to identify the content of this right, nor to exhaust the subject, the work aims to suggest the debate by the legal community by bringing theoretical and empirical contributions.
