EL PATRIMONIO INMATERIAL MÁS ALLÁ DE LAS FRONTERAS: ENTRE EL DERECHO INTERNACIONAL Y LA COOPERACIÓN GLOBAL

Contextualización: La adopción de la Convención para la Salvaguardia del Patrimonio Cultural Inmaterial por la UNESCO en 2003 representó un hito en la gobernanza del patrimonio cultural inmaterial (PCI), al consolidar un instrumento jurídico internacional para su protección. La Convención refuerza la cooperación internacional como principio fundamental, especialmente a través de las candidaturas multinacionales a las listas representativas de la UNESCO, promoviendo el diálogo intercultural y fomentando los esfuerzos conjuntos para salvaguardar el PCI.
Objetivos: El artículo analiza críticamente la dinámica de la cooperación internacional en el contexto del PCI, centrándose en las candidaturas multinacionales y su relación con el derecho internacional y la gobernanza mundial. El estudio examina si dichas aplicaciones son tanto un resultado como un medio para fomentar la cooperación internacional, tomando como caso de estudio la «Dieta Mediterránea», inscrita en la lista de la UNESCO en 2013 por siete Estados.
Método: La investigación se basa en la teoría y la práctica del derecho internacional y comparado, en diálogo con la teoría de las relaciones internacionales, adoptando una perspectiva transnacional para comprender la interacción entre los Estados y las comunidades en la protección del PCI.
Resultados: El análisis confirma que las aplicaciones multinacionales impulsan la cooperación entre estados y comunidades promoviendo la salvaguarda compartida del PCI. El caso de la Dieta Mediterránea ilustra este potencial, especialmente en Europa, donde la integración política y económica facilita la colaboración. Sin embargo, retos como las diferencias políticas y jurídicas exigen la adaptación de los mecanismos de cooperación más allá del contexto europeo, como es el caso de Marruecos. La conclusión es que el PIC puede reforzar la cooperación internacional y tender puentes entre naciones y comunidades que comparten un patrimonio común.
