THE APPLICATION OF LAW CANNOT BE A MATTER OF LUCK

Contextualization: In times of illegality and in the name of preserving democracy, the law can be an instrument of arbitrariness. Starting from a connection between law and democracy, Jeremy Waldron sought to establish the premise that the application of law cannot be a matter of luck. On the contrary, a right that claims to be democratic must be predictable, non-arbitrary and applied in such a way that the rules of the game exist, and are the same, for everyone (fairness/equanimity).
Objectives: Can this thought be linked to the thought of Lenio Streck, a jurist who founded, in Brazil, the Hermeneutic Critique of Law? This is what we seek to establish in this contribution, suggesting that the decision as an act of will, portraying the conscience of the judge, must be replaced by an interpretation that respects the semantic limits of the text, which contributes to a right whose application does not imply that the citizen/jurisdictee depends on luck.
Methodology: The deductive research method is used, using as a theoretical basis the studies of (post-)positivism, the theory of hermeneutic criticism of law and the literature review of Jeremy Waldron's main texts.
Results: It is concluded that it is necessary to respect the agreements legitimately set out in legislation, without subjectivist application of the order, a situation that would make the recipient of the official interpretation a hostage to fate. Likewise, it is not permissible to move political discussion to the judicial sphere as it represents a dangerous path to arbitrariness.
